THE ELD MANDATE EXPLAINED

The FMCSA’s ELD Mandate took effect in the United States on December 18, 2017. Canada’s ELD mandate is set for June 12, 2021, with a focus on education and awareness and enforcement penalties taking effect June 2022.

 

Paper logbooks used to record Hours of Service (HOS) are no longer acceptable when recording driving hours, rest time and on-duty hours. Instead, HOS must be recorded using Electronic Logging Devices, alternatively known as ELDs. Any ELD used to meet the federal mandate must be certified by a recognized third party to ensure devices meet technical requirements, which is a major difference from the U.S. rules that allow manufacturers to self-certify. This third-party certification requirement was introduced to help eliminate the potential for manipulating Hours of Service data. The ultimate goal of ELDs is to make roadways safer by reducing the risk of truck drivers driving tired, but they also save fleet managers time and money – two of our most precious assets.

Transport Canada has officially unveiled rules that will mandate Electronic Logging Devices (ELDS) in Canada, replacing long-established paper logbooks. The Canadian ELD mandate is in effect since June 12, 2021, with a progressive enforcement period for the first 12 months. This means penalties for non-compliance will begin June 12, 2022, and until then, enforcement by Transport Canada will consist of education and awareness. 

The mandate, itself, aims to improve road safety across Canadian provinces and territories. It requires commercial motor vehicle drivers subject to Hours of Service (HOS) conditions to use electronic logging devices (ELDs). To level-set, an ELD is defined as a device or technology that automatically records a driver’s driving time to better track, manage, share and improve accuracy and efficiency in the driver’s record of duty status.  

Transport Canada states that federally regulated carriers are required to migrate into ELD solutions. Currently this translates to over 150K commercial vehicle drivers across Canada.

For US, FMCSA clears the topic as:
“The ELD applies to most motor carriers and drivers who are currently required to maintain records of duty status (RODS) per Part 395, 49 CFR 395.8(a). The rule applies to commercial buses as well as trucks, and to Canada- and Mexico-domiciled drivers.”

Mandate exemptions include short-term rentals, commercial vehicles operated within a certain radius and are not required to comply with HOS regulations,
